E. State and Federal Regulatory Compliance
- MSDE & Office of Child Care: all child and family records are maintained in strict accordance with Maryland Child Care regulations (COMAR Subtitle 16/17). Records are accessible only to authorized EBA personnel, state licensing inspectors during official evaluations, or law enforcement officers as required by law.
- FERPA: EBA respects parents' and legal guardians' rights to review, inspect, and request corrections to their child's educational records maintained by our facility.
- COPPA & Children's Privacy: we implement reasonable physical, administrative, and technical security measures to protect your data. Our Website and public services are directed to parents, guardians, and adult community members. We do not knowingly collect personal information directly from children under 13 online. Online enrollment features requiring child data must be completed directly by a parent or verified legal guardian.

By providing your phone number and opting in to receiving text messages from Early Bloom Academy, you consent to receive recurring automated administrative, promotional, and personalized marketing text messages (e.g. SMS and MMS) from us.
- Message Content: urgent school closing/delay announcements, student program updates, event information, volunteer opportunities, payment reminders, and requests for donations.
- Scope of Consent: consent is program-specific and does not constitute consent to receive calls or messages from other unrelated programs or third parties.
- No Purchase Required: consent to receive automated marketing or promotional text messages is not a condition of any enrollment, service purchase, or donation.
- How to Opt-Out: text STOP to the number from which you received the message. You will receive a single confirmation message verifying your opt-out.
- Help: reply HELP to any message or contact us at admin@earlybloomacademy.com.
- Message Rates and Frequency: frequency varies based on school activity, emergencies, and your level of engagement. Standard message and data rates may apply.
- Carrier Liability: mobile wireless carriers are not liable for delayed, misdirected, or undelivered messages.
- Legal Notice on Electronic Communications: any electronic communication sent by EBA contains confidential and legally privileged information intended solely for the recipient. Unauthorized review, copying, distribution, or disclosure is strictly prohibited and may result in legal liability.
- Official Communication Channels: EBA communicates officially only through staff email addresses ending in @earlybloomacademy.com or through designated text messaging shortcodes/numbers. EBA is not responsible for fraudulent messages or phishing attempts originating from external domains.
- Errors and Omissions: while EBA takes reasonable measures to ensure accuracy and technical security, we are not liable for typographical errors, transmission delays, or unexpected system disruptions.
- Action Upon Misdelivery: if you receive a communication from EBA in error, please notify the sender immediately and permanently delete the message and any attached files.

Prohibited Conduct

To the fullest extent permitted by law, you agree to release, waive, and forever discharge Early Bloom Academy, its founders, directors, officers, employees, educators, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to:

You agree to defend, indemnify, and hold harmless Early Bloom Academy, its parent entities, affiliates, officers, directors, employees, contractors, agents, and licensors from and against any and all claims, liabilities, judgments, damages, losses, expenses, or costs (including reasonable attorneys' fees) arising out of or relating to:
- Your use of, or conduct on, the Website, mobile services, or online portals.
- Your violation of any provision of this Agreement or EBA policies.
- Your violation of any applicable local, state, or federal law or regulation.
- Any User Content or material you post, submit, or transmit through our systems.
- Your infringement of any intellectual property, privacy, or property right of any person or entity.
This indemnification obligation will survive the termination or expiration of this Agreement and your use of EBA services.
The Early Bloom Academy Website and digital services are provided on an "AS IS" and "AS AVAILABLE" basis. EBA disclaims all representations and warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, performance, quality, and non-infringement.
EBA makes no warranty that the Service will meet your specific needs; that the Website or mobile communications will operate uninterrupted, secure, or error-free; that information provided on the site will be completely accurate or up to date; or that technical bugs, defects, or system limitations will be immediately corrected.
To the maximum extent permitted by applicable law, EBA and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damagesโincluding loss of profits, data, goodwill, or system failureโresulting from your access to or use of the Service.
In no event shall EBA's total monetary liability for all claims under this Agreement exceed the total amount paid by you to EBA (if any) for accessing the digital Service. If state law prohibits certain liability limits, EBA's liability will be limited to the fullest extent permitted by law.
- Governing Law: this Agreement is governed by and construed in accordance with the internal substantive laws of the State of Maryland, without regard to conflict of laws principles.
- Jurisdiction: you agree that the Service is based in the United States. Any legal suit, action, or proceeding arising out of or related to this Agreement shall be instituted in the state or federal courts located in Maryland or the Commonwealth of Virginia, as designated by EBA.
- Arbitration Option: for any claim (excluding requests for injunctive relief) where the total damages sought are less than $10,000, either party may choose to resolve the dispute through binding, non-appearance-based arbitration administered by an established Alternative Dispute Resolution (ADR) provider.
- Amendments to Policy: we may revise these Terms of Service, Mobile Terms, and Privacy Policy occasionally. Any amendments are effective immediately upon the updated document's posting on our website. Please check this page periodically.
- Parent/Guardian Handbook Policy: EBA maintains an official Parent/Guardian & Family Handbook containing operational policies, drop-off/pick-up protocols, health and illness guidelines, tuition details, emergency procedures, and behavioral policies. All enrolled families and legal guardians are required to read, understand, and comply with it.
- Policy Binding: by enrolling your child at Early Bloom Academy and utilizing our digital or physical services, you confirm that you have received access to the EBA Handbook, have reviewed its contents, and agree to abide by all operational policies and code of conduct expectations.
